Does a husband need to add his wife as a driver on car insurance?

Asked by trailsillustrated (16804points) January 31st, 2011

I have recently left my husband. I asked if I could use the car, which was bought for me to use, but it’s in his name. He said no because I can’t afford the insurance. ( I haven’t worked in years) He has it insured in his name, would he have had to add me as a driver? His name only is on the insurance card, but I drove the car regularly for a year. Are married people covered anyway? This is in the usa.

Insurers automatically write spouses into insurance policies if they’re living under the same roof, unless specifically instructed to exclude them. After a separation or divorce, the policy holder would have to instruct the insurer to remove the spouse from the policy. If he hasn’t done that, then you should still be covered.

You can call the insurance company and ask. Usually, the car is insured under the owners name and for ANY legally licensed driver over a certain age… like 23. That is why we can borrow our parent’s car, or a friend’s car, for example… or drive them home when they’ve been drinking.

Perhaps he meant that he wasn’t going to insure the car any longer and if you used it, you’d be driving an uninsured car, which, I think, might be illegal in certain States…?

But I live in Norway, and it is definitely illegal to drive uninsured here.

The car is insured the way I understand it. Even if his work colleague drives it, the car is insured. However, if you drive it regularly you should be listed as the primary driver.

In the UK the car is insured for the owner/policy holder only. When I added the wife I had to put her down as a named driver! and this made my insurance cheaper
