What if August's 2011 French Vogue's cover pictures were found in a person's hardrive?

If a person was suspected of distributing child porn, and someone found these pictures, (accidently or not) in their harddrive, what would happen? Should magazines/TV networks, et al not be treated the same way? Isn’t the act the same whether it is commited in the open or not?

I don’t know child porn law, but I assume the kids have to be naked and/or in debaucherous positions.
I am pretty sure that Vogue knows exactly how far they can go, legally, to just stay within the borders of what is tolerable (again, legally).
I believe the marketing people did a ‘great’ job (considering that their job is to get their product across as much as possible), they are all over the internet and probably will see a rise in sells of their magazine.

You mean this? It does sexualize her somewhat but I don’t think that it would constitute child pornography by any legal standard. I do think sexualizing little girls in the media certainly doesn’t help protect children and adds to an atmosphere that supports the exploitation of children but I don’t think this is the same thing. It is kind of messed up though, in my opinion. Children should be allowed to be children. I’ve seen pictures of little girls in child beauty pageant that aren’t much better.
@flo It’s not porn. It’s a modeling picture. This is what models do. If it was found on a hard drive, my common sense tells me it wouldn’t be punishable.
This is not porn. It’s not cool, but not porn.
Edited to add: It’s not against the law, so it wouldn’t be punishable for a private citizen to have it on their hard drive. That said, if I found it on my husband’s hard drive, he’d certainly have some explaining to do.
It’s not even close to porn. Child pageants do the same thing.
This doesn’t seem pornographic to me. When I was a kid I remember similar hype around Brooke Sheilds being dressed in “grown up” women’s clothes for her modeling shots.
I have added to the OP, everyone. I am aware what do you call it when there is actulal act and exposed skin? But a person taking suggestive pictures and distributing them to pedophiles et al., what is the word? Distributing child what? What is the legal term?
Re. I’ve seen pictures of little girls in child beauty pageant that aren’t much better. That is why I didn’t just pick Vogue, see the “Should magazines/TV networks, et al…” I don’t know if the existance of other entities doing worse makes any act more acceptble.

@flo As far as I know, the only ‘distributing child…’ phrase is ‘pornography’. Suggestive pictures aren’t against the law.
This is no more child porn than the child beauty pageants that seem to be very popular in certain parts of America.
I believe the picture you are all looking at is the one @lillycoyote posted which explains why we are on different pages. I don’t know how there could be more than one August cover.

It’s the same type of picture, @flo. The child is fully clothed and isn’t engaging in a sexual act. It’s suggestive and icky, but not against the law.
I don’know @augustlan they look different to me. In the gold outfit, you can remove the make up, change clothes, shoes jewelery into age appropriate, and it is good.
