Who would have jurisdiction in this situation?

Asked by john65pennington (29273points) November 27th, 2011

Man was in first class seating aboard a jetliner, watching child pornography, while in flight to Boston and flying over several states. Several passengers complained to flight personnel and man was arrested as he deboarded the plane in Massachuttes. Question: since this violation of the law occured over several states, would each state have the authority to prosecute this subject for possession of child pornography? Or, would prosecution be limited to just the State of Massachuttes?

Wouldn’t it be a federal case of transporting Child Pornography?

It’s my understanding the place where the plane lands has jurisdiction. They can be prosecuted under state laws or Federal laws, or both.

If you think about this situation, the man has to be pretty stupid to do what he did. It’s such close quarters on an airplane, did he not think that other passengers would not observe his laptop child pornography?

Surely, this qualifies him for the hall of fame for The Worlds Dumbest Criminals…...........

I can’t imagine looking at any pornography, much less child pornography, on a plane flight. The guy is asking for help.
