How do I legally gain access to my mothers storage unit?
My mother had had a drug problem for years now…sad I know but unfortunately had stored a tonn of family items baby pictures etc in a storage unit. She has missed many payments and is not available to get in touch with in any way. The locker will go up for auction in 2 weeks and even if I pay it off they will not let me enter the unit to get my property. What do I do? Is there any legal right I have to the unit. Other than having someone buy the locker at auction ( I am out of the state and can’t attend) Any suggestions?

You could pay it off to prevent the auction from taking place, then write to your mother and your mom’s family/friends stating you are in want of the key to the storage unit you have now paid for.
Do you have other family members in the state of the storage locker? Possibly one of the family members could purchase via the auction for you?
This is a tough problem.
How about trying this. Will the locker-owners send you a copy of the contract your mother signed?
Look for a loophole in the wording and maybe you can find an out that will benefit you.
Pertinent news story ...maybe you could send someone to the auction. I don’t know how much the monthly rent is on the unit, but if all the posessions could be had for a hundred bucks, it’s worth a shot.
Yea I was thinking that bc if I get it I could buy it they would let me have my things. Only drawback is that 250 is owed sometimes they can get around the 1000 depending what people are there and I would hate to end up bidding so high for my own stuff :/
If you recall, how were the things packed? Boxes? Tubs?
Are furniture or electronics visible?
The payment for back rent will keep it from being auctioned.
The getting “power of attorney” may allow to take possession of all the items.
Then take trip over and empty the locker.
Contact someone in the region and have them go to the auction.
@SmashTheState I have to agree, as radical as it is. When the system fails certain circumstances, screw them.
Why can’t you contact your Mom?
If you can’t contact her, how could the storage unit people contact her for payment, etc.? Didn’t they ask for a beneficiary or emergency contact when she signed up? I can’t imagine they don’t have anyone else’s name on her application somewhere. If there is someone like that, they might be able to help.
But unless she’s been declared legally incompetent and you are her guardian or conservator, you have no right to that stuff.
I would consult an attorney… but I have a feeling if your Mom is still alive, you won’t be able to get anything from the unit.
