North Dakota just passed an abortion ban for woman who are carrying fetuses greater than 6 weeks old. Do you throw her in jail for getting an abortion at 6 weeks and 1 day?

There is surely a statistical margin of error in deciding the age of a fetus?
I’m not sure jail is the answer, but since abortion was made legal, there has to be a penalty for breaking a/ the law just like anything else.

It seems to be more subtle than six weeks plus a day.

I think the language of the law puts the legal ramifications on the shoulders of the performing physician, not the woman having the abortion.
As a physician, do you follow the intent of the law? Or do you find a way to perform the abortion if that is the woman’s desire? As a physician, if there was no restriction by law on the age of the fetus, would you set your own cutoff time frame for performing an abortion? What would be your guide and why or why not?
@bkcunningham That’s a great question. I don’t perform abortions as it’s not my specialty. To be honest, I’m not sure what their policy is and what our local cut off is.
