Walgreens drugstore refuses to sell beer on Sundays at 8 am. The law says you can sell at 8. Is this because they are a drugstore, not a grocery store?

I thought drugstore is a convenience store? I live at Elmhurst, NY 11373.

I don’t believe they’re legally required to sell alcohol at any time in particular, so it’s probably an decision made at some upper level for their own reasons.

If you can’t wait til after 8 for a beer, the selling policy is the least of your worries. lol
Plenty of other establishments you can go to. I agree with @syz most likely a private policy mandated by the owner or manager. Oh well.

Local law can restrict the times of alcohol sales in NYS, but it sounds like store policy. Why don’t you just ask the manager why they do it?

I’m pretty sure state law is not before noon on Sunday.

Have you checked the specific rule for the county you are in? Some counties in NY don’t allow sales until noon. If it is allowed in your county earlier than noon, it could be a Walgreen’s policy in order to be compliant throughout the state.

There may be ancillary laws, such as: no person under age 21 can accept money for alcohol before noon. And since the early Sunday morning cashiers are all 18–19 years old, the company may not want to run any risks.

I just read @Rarebear‘s link and it says NYS is not before noon on Sunday. So, assuming wikipedia is right, no county is before noon.

Who owns Walgreens?

@MadMadMax Possibly the Walgreen family still has controlling interest, I’m not sure. Why do you ask? I’m just curious why it would matter?

Sometimes owners like the Walmart family make religously inspired decisions regarding their sales practices; however, I just read up on Walgreens and I do not think that is the case here.

@MadMadMax I see. Good point. The store is just following state and county law I think. Usually stores that are owned by people that religious wouldn’t sell alcohol to begin with.
