Well, it’s tricky, but it is, actually. It’s not covered in the same way, as as you said it’s not a covered entity (not a provider or clearing house). However, it is also true that it is HIPAA compliant, in that it does not request or pass along any medically relevant information. So in a sense, it’s perfectly compliant. In the same way that, say, WhiteHouse.gov is perfectly compliant. I have also seen mentioned that the contractors were actually given HIPAA training, but I haven’t found a primary source and it doesn’t matter anyway.

The thing is @BhacSsylan it doesn’t even collect any medical information from people who are applying, other than whether or not they smoke. It carries no records and no history.

Exactly, that’s what I mean. It’s HIPAA compliant, because it does nothing that’s non-compliant. A bit of a stretch, I’ll grant, but it’s technically true.
