How did insurance companies decide on the value of human life at $5 million?

It is my understanding that a settlement of this nature would be determined by lawyers for both the city and Mr. McDonalds family. I am not sure though if cities have insurance policies in place to pay lawsuit settlements costs or if it comes from a special fund the cities or states set aside.
