Could I have sued Total cereal for sending me to the hospital? (details inside ) (NSFW )

I watched a commercial for Total cereal , when i was 15, and it said that I had to eat 16 bowls of raisin bran to match the fiber in Total. SO I DID. I ended in the hospital in pain. I was in the hospital until I made a bowel movement. Which was a week. Do you have any similar mistakes or stories? At least can I get that commercial edited with a warning?

You wouldn’t sue Total, you should sue the Raisin Bran company. If you couldn’t poo after all that Raisin Bran, that brand was seriously deficient.

(Fiber doesn’t constipate you, it has the opposite effect,)

Probably not, as you were a minor. They’d say your mother was supposed to be supervising you.

See the last sentence in the observation made by @zenvelo.

So, either total BS or your memory of childhood isn’t nearly as good as you think it is. In any case, this isn’t the first time…..

Memory can be pretty unreliable actually. For instance, different eyewitness to the same event will often give differing, often conflicting, accounts (this is popularly known as the “Rashomon effect”).

Fiber only makes you poo if taken with a sufficient amount of liquid.
AND I’ve heard you tell this story before, so I half ass (~) believe you.

No, you cannot sue.
It would be like suing Dentine gum when your filling fell out because “4 out of 5 dentists recommended it”.

Or suing Almond Joy because “you feel like a nut”.

There is not a chance you would win. Any lawyer would laugh at you.

The cereal company sold the cereal, and on the side of the box it says “Serving size: One cup” or something similar.

You, the buyer would have made the idiotic decision yourself to eat 16 times the serving size. The company is not responsible for your stupidity.

It would be similar to this situation: Let’s say that you own a radial arm saw. Your fingernails need cutting. So you turn on the saw and put your finger close to the blade in hopes of trimming your nails. Instead you cut off your finger.

You would have been using the saw in an inappropriate way. Does the saw manufacturer need to put up a warning side: This is not a nail clipper!

Haha, no. Them saying “you’d have to eat x bowls of y cereal to get the same effect” is not a demand for you to do so!

@DrasticDreamer is correct. Fiber without sufficient fluids can block you like a dam.

You and you alone are responsible for the stupid things you do. If someone tells you to take a jump off a cliff the decision to jump or not to jump is yours.

The clear intention of the commercial was to discourage people from buying the rival product. The case would be thrown out of court.
