What are the chances that Apple are going to sue this company?
There is a company that has developed a line of laptops called the HakBook Elite. Its basically a PC laptop running Mac OSX and they are only charing $329 for the laptop. They most certainly do not have Apple’s approval to commercially sell laptops with Apple’s OS on them.

Probably a pretty good chance of a lawsuit.. Apple’s terms of service on OSX are pretty tight, and they have sued other companies in the past for doing much the same thing.
life is tough when you are a monopoly. You have to smash competition rather than improving your product.
Apple has sued hackintosh makers before so there’s no reason to think they won’t now.
I’d say the chances are about 100% eventually. The likely reason they haven’t done so yet is because they’ve been small enough to be flying under the radar.
I’ve seen ads popping up on Craigslist from time to time from people selling hackintoshes of one sort or another. I’ve no doubt that Apple catches up to them sooner or later.
