If Trump's wiretapping claims are baseless, should Obama sue him for defamation?

Asked by LostInParadise (32169points) March 17th, 2017

Trump is immune to criminal charges but not from tort law. I would love to see it happen. As with Trump University, his best option would be to settle as soon as possible. That would be fine with me. That Obama is black and Trump is a racist would make it that much sweeter. Even better is that Trump made a stupid campaign statement about making libel laws tougher. Sweet irony!

Obama is a better person than I am and I doubt if he would bring a lawsuit.

Here is an article that discusses whether Trump could be prosecuted. It would be a tough call.

No. Even if we assume that he is allowed to sue and that he would win, a defamation suit doesn’t get Obama anything valuable. The whole thing would look petty and political. I’m sure he would rather hold onto his dignity and political capital than trade it in for some paltry amount of money.

Could he? Yes.

Should he? No. Better to let Trump stew in his own juices. A lawsuit would be a distraction.

Hell no. Obama shouldn’t demean himself by giving these asinine accusations any gravity. Bloody hell. It’s satisfying enough to watch this asshole continuously prove that he is not at all qualified to serve as President of anything other than the local Chamber of Commerce—and I would question the wisdom in that.

It isn’t a question of if the claims are baseless they are baseless. The lack of respect shown to the previous president and to the truth is breath-taking but I think Obama would be wise to keep out of it. Trump is already in court, the larger court of American and world opinion, and it doesn’t look at all good.

I have emailed my Congressmen, my Senators, my Governor and Paul Ryan to tell Trump to cut this shit out. I even emailed the White House. Got little done at work today because of this.

Obama hasn’t been defamed. Rumpy is making an obvious ass out of himself so what would Obama have to prove?

MrGrimm888's avatar

No. It is only defamation to Trump. As I’ve said, the person working hades to drag Trump’s name through the mud is Trump himself. He’s getting to the point where I feel embarrassed for him.

I knew I wouldn’t like 4 years of Trump, but I didn’t know that he would bitch, and moan so much.

The man has a country to run, and he’s focused on imagined past grievances. I suppose this is all an attempt to distract us all from what an awful president he is…

I think defamation has to have some consequence, like losing a job or something, or suffering financially because of it. Obama hasn’t lost anything. A petty crap flea like trump couldn’t affect him in any way.

Darth_Algar's avatar

No, Obama should not. It would only look petty and, well, Trump-like, on his part.

“Trump is immune to criminal charges”

No, he is not.

I said it right after the election, and I’ll say it again, I think Trump will be / now is shocked about how much less power he actually has as president than he did as Mob Boss of his enterprises.

@JeSuisRickSpringfield I agree but something has to be done to shut him up. He can ignore it but I don’t think Trump will stop at this last lie. He will continue to spread falsehoods about President Obama because he won’t be happy till he destroys him. I don’t think Trump is sane enough to realize when enough is enough. He is mad jealous of President Obama. He is everything Trump will never be or ever have. Like sanity.

And good grades.

What if Trump says he got his information from Breitbart? Could he get away with that? Even if the Breitpart reporter were questioned, he might say that he wants to protect the identity of his source. Legitimate news sources (not Breitbar, obviously) do that all the time. That is how we got all those White House leaks.

I would love to see something done to make Trump think twice before making up alternative facts. Is there some way that Congress could force him to retract any of his lies short of threatening impeachment?

@LostInParadise It doesn’t matter where he got it from. He himself did not have proof. He damages the office of the Presidency by spreading conspiracy theories. The President is not suppose to spread theories. He accused Obama of a felony without proof. He’s not a little gossip nobody any longer. His words have weight and it cost us money to investigate every little conspiracy theory he has. But also, he becomes the boy who cried wolf. One day we may need another nation to help us out and they may decide to wait it out to see if what he says is true or something he read in the National Enquirer or from Brietbart. The same way our Nation looks at N. Korea’s leader is the same way they either are or will look at Trump. They will eventually think there is no reasoning with him and our government has no control over him and his lunacy. They will eventually see us as a global threat. Except for Russia who has him on lock down for now.

I heard that it’s sinking in that he’s taken this wire tapping BS too far and he’s angry and embarrassed and taking it out on the staff. I hear that he’s pretty damn abusive all the way around. Love Rogue POTUS Staff

He hates President Obama so much, that I think he actually believes him to be his enemy.
