Does a condemned man (capital punishment) whose execution is called off at the last minute get a second last meal when his sentence is reinstated?

Asked by elbanditoroso (33577points) November 15th, 2017

We have all seen this – a person is set to be executed at midnight, but just minutes before the execution is to take place, some court or another puts a stay on the execution for the time being.

In that scenario, presumably the criminal has had his ‘last meal’ and is close to being in the room where the execution will take place.

Many of these last minute reprieves are temporary; the guy will be executed a couple days, weeks, or months later.

If that happens, does the criminal get a second “last meal”? Or has he already gotten his once?

Let’s hope so! Justice? 2 appointments with death deserves 2 meals.

How about if the condemned prisoner, knowing that he has, say, severe lactose intolerance, asks for something like ice cream or cheese, and receives that. Would he still be executed if he were experiencing “severe gastric distress” or even worse, some kind of arrest because of the deliberate food choice?

@CWOTUS – great answer! That introduces some really nasty complications.

I sure hope so.

And I wonder what happens if he asks for hemlock.

My last meal would put me in a coma, just from sheer overeating.
A bucket of KFC to start…

I don’t know about the process, but I used to read a story on newspaper about a guy whose punishment was changed from death to life sentence at the last minute. He was about to have his last meal when they announced that his punishment had changed. He lived to tell the story to the press.

So… I don’t know anyone who had their punishment delayed, but it’s possible for a death row prisoner to live.

Oh, that would suck.
Good news, you’re going to live. Give me that pheasant under glass, dinner is bologna and goulash.
