What happens on your first DUI?

Asked by MooCows (3216points) April 5th, 2018

Was wondering what happens to you in Mississippi
on your first DUI with no prior record—no wreck
no one injured—just a traffic stop. A lawyer has been
retained but the court date hasn’t came up yet.
Wondering what is in store before court.

According to this , The first drunk driving conviction you receive in the State of Mississippi will cost you a $250 to $1,000 fine or you may be imprisoned up to 48 hours in jail or both.

You will also be ordered to attend and complete an alcohol safety program or attend a victim impact panel or both.

Your drivers license will be suspended for a minimum of 90 days and until you attend and successfully complete a alcohol safety education program.

I’d ask that lawyer you retained.

I don’t know about Mississippi, but my daughter got a DUI. She was just about to pull into her apartment complex parking lot when a cop flew up behind her.
She had to have a breathalyzer installed, at her expense, in her car, and then had to drive to Wichita 50 miles away, every month to have it removed and read, and then reinstalled. Cost her $90 every time, and that isn’t including the gas.

If you are in active military…would that change anything?

@MooCows it doesn’t change your civil penalties. If your branch of the service finds out , they may make you got to a diversion program.

$2,000 lawyer fee
$650 negotiated between lawyer and DA then presented to judge
$225 2 classes you have to take
120 day license restriction starting in 45 days
In 6 months if all the above is met the DUI will be expunged from his record
(that is what the lawyer was for..to get it off his record)
He will be kicked out of the CG as they are the only military group that
kicks you out on first offense…but he will get an honorable discharge.
At 27 pretty sure he learned his lesson….lost a great career.:(
He could have been charged up to $1600 so the $650 was a blessing.
That is what happens in MS.

I believe that there are many people that really do not know for sure
what happens and how much money it cost when you get a DUI.
I for one had no idea that the FIRST offense cost this much and you
couldn’t drive for 120 days. I am not saying he didn’t deserve it just
that the general public needs to know what they are really up against
when they drink and drive.

@MooCows That is actually relatively inexpensive compared to some states.

In California, expect to pay a lawyer $4,000 – $5,000. Fines are usually $1,000 plus “administrative fees” which add $1,100 to the fine. 3 to 6 month weekly DUI course costs another $750 – $1,000. License suspension is 4 months, plus completion of DUI class. And then, you may be required to install an interlock breathalyzer devce on your car(s) at $750 each.
