Do you really think Roe v. Wade will be overturned?

Asked by Demosthenes (15305points) July 10th, 2018

I hear a lot of talk about this, but most of it sounds fairly alarmist to me.

Brett Kavanaugh apparently has supported “restrictions on abortion” but has respected Roe v. Wade. That could change, of course, but how likely do you think that is?

Consider attempts at getting rid of it a guarantee.

I put nothing past, Religious, right wing extremists, I wouldn’t be surprised if they try an outlaw being gay as well after all it’s just a choice you know.

The court won’t do it directly. The way it will work is that SCOTUS will permit all of those obtuse measures for which our 3rd world states are notorious to stand. You know, crap like requiring clinics to show women pictures and films of abortions, and laws which in effect make it impossible to even have a clinic. Even if Roe is overturned tomorrow, abortion IS HERE TO STAY in places like California, New York or the city of Chicago (a defacto state). The reality about abortion is that even with Roe in place, the issue of abortion remains as it has always been, an obstacle only for poor women.

The religious right will try to overturn that just as much as the anti-gun left will try to go after the 2nd amendment. I don’t think either have a chance.

I don’t know. We will have a lot of young women dying due to botched abortion attempts if it does get over turned.

SQUEEKY2's avatar

And that will be God’s will, according to these right wing freak jobs.^^
Remember if they just practiced abstinence they wouldn’t have gotten into that mess in the first place.

Dutchess_III's avatar

They mean, the GIRLS should be practicing abstinence….Men just need to be out there doing what men do.

SQUEEKY2's avatar

Yeah, pretty much!^^

@stanleybmanly has it right. A state will pass a law to make it illegal. A court case will come out of it. The issue will be appealed to SCOTUS. SCOTUS will overturn Roe v. Wade, which will leave it to the individual states.

Aborthion will be legal on the coasts, illegal in the flyover states.

No. At least, I sure as hell hope not…

Before Roe v Wade, young girls were getting abortions in dirty back rooms with coat hangers. Many returned with terrible infections & an even larger amount almost died. Whether or not you agree with abortions, I see it as protecting our young daughters when it is performed by a doctor in a clinic in place of some quack in a back ally somewhere.

Yes, and watch for an attack on Brown vs Board of Education. This is another ruling that sticks in the craw of many a conservative. You can already see the build up with the administration going after affirmative action programs in colleges.

ARE_you_kidding_me's avatar

@rojo I would expect something like that on a headline from the onion. You can’t possibly be serious.

The fact you are asking means you don’t understand what that case was about. Roe is a case about privacy rights, not abortion.

Dutchess_III's avatar

The privacy issue was their argument, but it was all about abortion. ” The court held that a woman’s right to an abortion was implicit in the right to privacy protected by the 14th Amendment to the Constitution.” source

MollyMcGuire's avatar

Without the implied right to privacy there would be no legal abortion.

Dutchess_III's avatar

The privacy laws were the vehicle used to change the law regarding abortion, but Roe v Wade was all about abortion laws.

stanleybmanly's avatar

@MollyMcguire I wouldn’t be so sure. The privacy opinion might well have been the excuse to avoid the contentious question of the government’s right to force a woman to bear a child.

Dutchess_III's avatar

I never looked at it quite like that before, @stanleybmanly. But…yeah.

Study the opinion.
