Upskirting.

How would you like to see upskirters punished?

I think it’s only a misdemeanor in LA city or county, which majorly annoys me.

YES! ▲

Is it a felony in ‘frisco?

Feel free to insult LA. ;-)

If I was like the mighty Serena Williams, I’d stomp his phone while it was in his hand, and serve his head for an ace.

It’s sexual assault. It should be a felony and put on the sex register. It is not a boyish prank.

I basically agree with @zenvelo.

However, if the perp uploads it ANYWHERE, I’d give him a FULL dime for the crime.

I would like them to pay the agreeable amount (as stated by the law. Yes, we should make a law about it) to the person they took the pictures from. Here’s the problem, no matter how you dislike the idea, once you got your under-waist picture taken and it flies around in the public there’s nothing you could do about it. If the person uses your picture for advertisement or derives any benefit from it then you might as well ask to be given your share. It is better to gain a benefit from an already unrepairable situation. It will at least turn in to a good business negotiation.

I would like it becomes a felony when the perpetrator failed to pay the stated amount (as a form of penalty) to the victim.

I have had my personal body pics (that include under-waist pics) posted in dating sites and if someone upskirt me then I think it will make no difference, but if that person gain fortune from it then I’ll want my part too since it’s my pictures. Whether we like it or not, once your pic is out there it’s out there, people would have seen it already and perhaps have a copy of it. It’s already a lost cause. Instead of relish in negative feelings such as embarassment we should think forward and make use of the situation so it will still be beneficial for us in the end.

They should sue the phone manufacturer.

Looking, no. Photographing, yes. Women have an expectation of privacy under their skirt….....well, under skirts no shorter than five inches above the knee anyway. ;)

Personally, I would feel the same as I would if a Peeping Tom spied on me through a window, or someone had installed a hidden camera in my bedroom, bathroom etc. It is a gross invasion of privacy. I don’t know if it is illegal in the US, it’s not here in NZ but I know the government is looking again at the issue. I would certainly support any move to legislate against it.

@Unofficial_Member Do you understand the concept of consent? And why it’s important?

Dutchess_III's avatar

Of course is should be.

chyna's avatar

Personally, I can’t imagine letting someone get that close to me that they could get a selfie stick or their phone/camera on their shoe between my legs to get an upskirting shot. I don’t like people touching me or in my personal space.

Dutchess_III's avatar

@chyna From what I’ve heard it happens in crowded public places without women’s consent. Have you never, ever been in a crowd? Sometimes you can’t protect your personal space as much as you would like. Plus they don’t even have to be that close.

chyna's avatar

I live in a population of about 6,500 people. I generally stay away from crowds, but I do understand how it could happen in big cities or a very crowded area.

Dutchess_III's avatar

Yes. When I was in college we frequented bars that would get super crowded. Those are the times I would get groped or pinched. It didn’t happen just walking down the street. I just got cat called walking down the street, but not physically insulted. I can see how upskirting could happen in a crowded bar like that.

What the hell would a man even get out of a picture of some woman’s underwear???

Unofficial_Member's avatar

@ScienceChick Of course I know about that. Like I said, I care about making the most out of a bad situation as well as the future. You can get stress over the fact that your personal pics have been taken without your consent and have spread in the public but what will you get? Nothing. You’ll eventually have to move on with your life and stop wallowing in self-pity. The pics are already out there no matter what you do so it’s better turn it in to lucrative situation for yourself. I have no regret in my life and I always think of a way to benefit me in any situation.
