Why does this guy want a bill of sale on this salvage vehicle?

Asked by Dutchess_III (47126points) August 28th, 2018

I bought a car, a Buick, in 2007. I can not get a title for it. Long story.

In 2012 or so we gave it to Rick’s daughter as she drove for work a LOT, so she needed something that gets good gas mileage. Rick’s company provided him a car.

I really liked that car but apparently the transmission went out so she sold it to some guy for salvage for $100.

Well, she called last night and said he wants a bill of sale. Why would he need a bill of sale? If we were the ones selling it I don’t think we could come up with a bill of sale ourselves. (long story.)

He also wants proof that it has had insurance on it in the past.

What’s up with that?

So there is a way to trace the car to prove it wasn’t stolen. The guy is really trying to protect himself and I would too. I would assume it’s the same with showing insurance.

To protect himself legally, yes.
At the office, when we accept packages for the neighbours, we keep the little notice cards the delivery guy left in their mailbox, when they come pick up their packages. So that later, they can not come back and claim that we kept their stuff for ourselves.

And what do you mean you can not come up with a bill of sale?
All you need is to write a little text.
Something like
“I, [dutchess], affirm that we sold [car] to [some guy] for [n] dollars on [date].”
Followed by your and his signature.
And each of you gets a copy.
Could not be more simple.

Does this mean he thinks it’s worth fixing and then reselling? If so, hell, I’ll just go get it and have it fixed. It’s a damn good car.

I’ve sold things. I know what a bill of sale is. This is a unique circumstance.

So he can get a title. Even if you sell a junker to the scrap yard, they want a title. If they or someone else wants to reconstruct the car/truck, they need a title.
And they will have a way of knowing for certain that you didn’t steal it, and wreck it out for parts, or whatever.

I think there is some clearinghouse of all salvage-status cars that the insurance companies use, so that a person can’t try and insure (re-insure) a vehicle that has already been written off. I know that after the hurricanes last year, bunches of cars were written off (and insurance paid for them) – and the insurance companies aren’t going to write insurance for them again.

She should be able to write the bill of sale, but be sure to include the VIN on the sales document.

As far as proof of insurance, it isn’t any of his business whether your daughter had it insured or not. Although he probably wants the proof of insurance to guard against insurance company (for the reasons I noted above)

@Dutchess_III – if you can’t get a title for the car, how have you bought your license plates and yearly stickers?

Dutchess_III's avatar

Well, I just did. I paid them online, and the Buick was listed as one of my vehicles so I registered it every year. IDK. I sent you a message explaining how I got it this fix.

At one point the car was sold as scrap for $100? Wow, somebody got screwed! I sold a non-running 97 Nissan pickup to the wrecking yard, for scrap, and got $300

Dutchess_III's avatar

Well, I really wanted to take it back but got vetoed.

You have to be the title holder of the vehicle. I’ve seen what car conversion looks like and it’s ugly and gets everyone in trouble down the line.

Dutchess_III's avatar

I told you we can’t get a title.
He’s parting it out, anyway.

If you can’t get a title, it sounds like someone still owes money somewhere down the line on the vehicle and it may still be collateral for loan. It sends up a red flag.
