If it's against the law for an adult to have sex with a minor, why is it legal for two teenagers to have intercourse?

Asked by luigirovatti (3002points) January 6th, 2019

It’s anyway illogical of teenagers to understand the implications of making love.

In my state underage is underage.

If you or your partner are under 15; the older person can be charged with statutory rape.

I asked another question. I meant both.

Read the answer ^^^^ ! IF you are under 15 and have sex with another 15 or 16 year old, the older person has broken the law.

If you actually included BOTH people as underage, why? What if they love each other? Must we negate them that pleasure? And anyway, in your answer you said “you OR your partner”.

Okay laws don’t count for you! IF you want to drive at a hundred miles an hour; you think it okay because you to drive fast (don’t speed and go to court with that defense).

OVER AND OUT !

It’s not in every country that people underage can’t engage in sex. Maybe even within a community elsewhere than America.

And for those wondering, I OBVIOUSLY didn’t engage in any illegal sexual activies.

In the U.S., laws vary considerably by state. In Virginia, where I live, it’s a crime for anyone to have sexual contact with someone under age 18. By contrast, in West Virginia, a crime occurs when (a) one person is under age 16 and (b) the other person is more than 4 years older. Thus, in WV, a 19-year-old can have lawful, consensual sex with a 16-year-old but, in VA, doing so would violate the law.

So, there’s no blanket rule. The age of consent differs and, depending on the jurisdiction, it may or may not be allowable to have sex with a minor.
