Is the following description of the penal law given by episode 5, season 2 of "Law and Order" correct?

The penal law allows a single affirmative defense to endangering the welfare of a child: spiritual healing by an organized religion. In ‘73, Congress passed a child abuse bill. $85 million to the states. ATW regulations said any state without a spiritual healing exemption didn’t get money. It was valid for a time in 44 states.
