Because they are criminally insane, so they don“t go through the criminal justice system.
It’s a good question and I’ve wondered about it in the past. It’s not always true, though. In the recent Tom King run of Batman there was an entire issue devoted to a trial of Mr. Freeze. Bruce Wayne manages to get on the jury (which is a direct ethics violation since he was the one who caught Mr. Freeze) and convinces the jury to let Mr. Freeze off. It’s a bit of a “you have to read it to understand it” story, but it’s a fabulous issue.
All of the bad guys are batty so it only makes sense to send them to the nut house.
@SABOTEUR No trial? No judge? No jury? Here in Idaho, if you are deemed mentally incapable of being tried in a court of law, you are held in a mental institution until you are well enough to stand trial.
Maybe they do have trials, we are just not showed the process?
Most superhero stories, at least in the early day, are very clear-cut in terms of the good guys and bad guys. So naturally the stories assume the bad guys are guilty no matter what, so it would be rather redundant to show the entire process of a trial when you know they will be found guilty anyway. They are just focusing on the more interesting stuff.
I asked a question here years ago about why couples in film-noir fell in love just after days of meeting each other. I remember one answer said that they might have been around each other for much longer than I’m showed. I think this follows the same logic here.
A trial is too boring an endeavor to be dwelt on in any depth. The Batman serials aren’t there to appeal to Perry Mason, Law & Order or witness for the Prosecution devotees. The producers want your 8 year old to stay awake.
Batman villains are all stark raving bonkers and must be locked up as soon as possible. Stopping off on the way to Arkham Asylum to call in on some court is not a good idea. We don’t want the Joker slitting the throats of the jurors then blaming it on a troubled childhood.
Also remember that most of the villains have had run ins with the law before, so they are only out of the mental health ward on good behvior demonstrating “recovery”. But as soon as they get violent again, back in they go.
