Did J6ers get harsher sentences than what a typical sentence would be for a similar crime?

Asked by JLeslie (65742points) 1 week ago

An assault, vandalism, or trespassing on federal property, I have no idea all of the charges that were filed or how many people were convicted in the end for criminal behavior on January 6th at the Capitol.

I know a lot of Trump supporters say there were no arrests for other instances of rioting, especially during the BLM protests, but that is just blatantly false, people were arrested and convicted and spent jail time. I am sure some people got away with light sentences or not being arrested or convicted, but plenty were. The system is not perfect and never has been.

I ask because people are talking about Trump pardoning people for crimes committed on January 6th.

Frightwingers definitely think so, after all most of them thought it was just a big snuggle fest.
Shit you listen to them they claim they were the victim.

I just read that the median sentence for the 376 rioters was 60 days.

The obvious answer is yes. Many were charged and sentenced to obstruction charges that were ruled unconstitutional. But they had already spent much of their sentence before that came about and weren’t immediately released if they were released at all. I believe all that is still pending with the DOJ. Many were also held for extended lengths of time (years) before even getting a trial scheduled.

They were all treated with kids’ gloves. They should have gotten the death penalty.

They certainly got lighter sentences on average. I just hope that it leaves a black mark on them in society reducing their opportunities and affecting their employment. There is no need for this kind of rebellious barbaric action in the US society in this millennium.

To answer accurately, one would have to look at others who committed the same crimes (which, as everyone knows, all depend on circumstances and some have better defense attorneys than others, so that’s hard to compare), then you’d have to look at the convictions and the sentences for each. To do that would take a bit of labor and it may be broken down in an article online but what to even search for? There are plenty of articles about the crimes and sentences, but to compare them as the OP is asking would be the difficult part.

It’s already been empirically proven for a very long time that white people receive lesser sentences than any black or Hispanic person would receive.

These are “good ole boys” that were “standing up for what’s right for muh boys”.

But yet Trump lovers will say there was no insurrection, it was a lovely tour for tourists to the building. In the meantime, videos show the insurrectionists hacking at the doors and breaking windows, sitting in offices with their feet on the desks, etc.

MrGrimm888's avatar

There are no “similar” crimes, to violent insurrection…
A LOT of people actually didn’t get the charges thet should have.

Trump and his conservative followers, support shooting shoplifters…

jca2's avatar

@MrGrimm888 Is there a link for that? I haven’t heard that. Not that I doubt it lol.

SQUEEKY2's avatar

@jca2 I heard that as well a while back it was on some news cast.

^I was going to say, I thought everyone had heard him railing about killing looters and shooting these mass robbery people. (People who are mostly drug addicts, and need help.)

Kill ‘em all, and let God sort ‘em out…

I wonder if trump’s turned his guns over yet.

Cant remember anyone else trying to overthrow the US government who didn’t get the US military instantly dropping a billion dollars of ordanace on.

In comparison they got away quite lightly.

LifeQuestioner's avatar

It’s hard to say because there’s not really been a similar crime.

JLeslie's avatar

Sure there are similar crimes of vandalism, attacking an officer, destroying public property, etc.

MrGrimm888's avatar

^Those are just charges, that should have been added to insurrection. In some cases, sedition.

This was an organized event.
Not a protest, that went sideways. The entire purpose for the gathering of Trumpers, was to deny democracy, and to keep Trump in power.

Given that it WAS at THE Capitol Building, and a multitude of American leaders were almost lynched. Including the VP.

LUCKILY, there is not a comparable crime.
LUCKILY, our election results, and laws, are typically respected.
LUCKILY, it wasn’t an army of minorities or they may have all been killed, or at least never see the light of day again.
They would NEVER have let dozens of “Black Panthers” to take up positions in trees and in other places with AR-15s surrounding The Capitol Building.
It’s total BS, that the J6ers didn’t get treated REALLY well.
I guess it’s because they, were “fine people.” Not “vermin.”

JLeslie's avatar

^^Not everyone present is going to be charged with sedition. I’m just asking about crimes that we can find similarities.

Stated above average sentence was 60 days. Some people just received probation. Trump and Republicans would have us believing there are hundreds of people rotting away in jail for years. It doesn’t sound like that is the case.

I found this: https://www.justice.gov/usao-dc/43-months-jan-6-attack-capitol#:~:text=Sentencings%3A&text=Approximately%20944%20defendants%20have%20had,sentenced%20to%20periods%20of%20incarceration.

An interesting thing happens, when you go to prison. Even for a little while.
Most probably had trouble keeping their jobs, and I know many were fired. (Deservedly so.)
There WERE some people there (Proud Boys, Oath Keepers etc,) that were domestic terrorists, actively working on overthrowing the government.

There WERE definitely some people who just showed up, or went with friends, and got caught up in the moment.
BUT. That’s no excuse, as far as the law goes.

It’s not JUST J6, that is a factor. They HAVE to make sure Americans know, they cannot simply attack the government if they don’t get their guy in.

To some, the penalties seem harsh. Mostly, wrists were slapped, compared to the punishment for such crimes in another country.

As far as Trump painting the scenario differently, that should surprise nobody.
But make no mistake, Trump used those people.
He didn’t care if they went to prison.
He didn’t care, if members of the government were lynched!
He’s a fucking coward, who talked a lot of gullible people into fighting for him.

smudges's avatar

^^ And he fooled those gullible people again. Fool me once shame on you…

MrGrimm888's avatar

^That’s EXACTLY what I have been saying.
It was Trump’s fault, the first time as he fooled people.
This time, the shame is on the people who voted for him.
