Have you ever had the state or department of highways take your property?

If so, did they pay a reasonable compensation?
I received a letter today from the department of highways saying they will be taking a portion of my property to install a sidewalk. They said I would be compensated, but i wonder if it will be a fair deal.

Hmmm. They’re paying for it? So compensation is so you don’t get upset?

Having a sidewallk installed doesn’t seem so bad. It’s not like they’re taking it to widen the road. Around here we’r responsible for the upkeep of our sidewalks. Having said that, I’ve never had property taken.

Depends on the offer you can barter to a point but in the end they will say we are going ahead and this is what we are going to pay for it.

I’m actually glad they are putting in a sidewalk. It will give me another area to walk to.
I just didn’t know if it would really be fair market value or a token gesture.

Yes I did. Lost a car to them. I still have the title.

Well the plats are laid out that includes an easment that belongs to the city. Basically it’s from the sidewalk out to the curb. But you are responsible for the upkeep. And if you repair or replace the sidewalk you pay for it.

I would call the person who sent the letter and tell them you’re just curious, what the compensation would be.

@chyna my guess is that it will NOT be a token amount. They have to look at the fair market value of the land (not the house plus the land) and then calculate how many square feet they will be taking versus the whole square footage of the property.

You won’t get rich, but it will be more than, say, $100.

@Dutchess_III That may be different from town to town. If @chyna got that letter, it sounds like the easement may not apply in her case.

No, but I wish my town would do that. We have no sidewalks.

The government can take property but must pay market value to the owners.

Imminent Domain, for a sidewalk?..
I’m surprised they are paying you anything.
Depending on foot traffic in your area, it may be wise to install at least a 4ft fence by the sidewalk. Otherwise, your yard will collect litter.

The street is not your yard @MrGrimm888. They aren’t going to drive up in your yard to clear your fence line. Plus they mainly sweep dirt and leaves. Maybe some trash that’s caught against the curb.
We had a fence around our back yard. After a windy day I had to go pick up all the trash that blew against the fence, especially on the west side.

^No. The letter said they would send out someone to discuss the details, so that could mean a few days, weeks, months or a year.
