Is it legal to drive and talk on the phone using my iPhone headset - with the buds in both ears?

Asked by Trustinglife (6671points) October 30th, 2008

Please don’t tell me it’s bad to talk and drive.

My friend told me that it’s illegal to have an earpiece in both ears. I wasn’t sure whether to believe them. So I’m asking you. I live in California.

It’s not legal to drive in California with headphones.
Regardless of whether it’s for your phone or for music,
I would think buds in both ears would fall under that law.

That would be, officially, no.

It’s not technically illegal in that state I don’t think, but it’s a really bad idea for both ears to be plugged up. One, fine your choice, but two? You’re seriously limiting your ability to not only pay attention to the road but see, hear and react to your surroundings.

Why not get a car adapter? I was almost ran off the road a few weeks ago by a woman in an SUV chatting it up on the phone. She passed me, missed her turn, and plowed into the side of a minivan at full speed.

Regardless of what you think about your ability to multitask while driving, you’re a danger to others.

The speakerphone function on iPhone is pretty great. It has a really good microphone, though, so you’ll need to turn down the tunes.

I got pulled over last week for the first time ever. I admitted that I was not paying much attention to the road while on the phone. It was the first time I was using the iPhone headphones and the first time I had ever bothered to use handsfree. The cop was nice and let me go, but warned me that I’m not technically supposed to have both in and be more careful. I’m in NY so I don’t know how similar the laws are.

Nimis is correct. It is illegal here in the great state of California. Of course if the governor can ride around on a motorcycle without a license then you should be able to do what the hell you want too.

I’m in CA and use the iPhone headset in one ear while driving – until I can afford the Bluetooth headset.

One ear is OK.

You just can’t use headsets… things that block both ears. A single-ear device is fine, since it leaves one ear free for, oh I don’t know, oncoming official vehicles, train sirens, car horns… all the warning things you’re meant to hear before you die, so at least you know how you f——- up.

That said, feel free to wear buds in both ears. You could win an Award

It’s 100% illegal. Check out the DMV website:

p.s. Don’t substitute Google for Fluther. It took me less then 10 seconds to find the above link.

Here in IL, it’s legal to use a headset with a single earphone, but not two. It’s probably the same in every other state. With earbuds, you would stand a smaller chance of being noticed, but if a cop was right behind you or right ahead of you, you would probably get pulled over.

BTW – it’s a bad idea, legal or not.

it’s not legal in Cali to drive with both headphones in your ears. You can drive with one, but not both
