It is an illegal sublet, and abrogates your lease, allowing them to evict you if they choose.
You need to look at your lease. Specifically the section about subletting.
if YOUR lease does not allow subletting, the owner can evict you and your tenants AND file suit against both you and the tenant.
both you and tenant homeless, you in court, and the tenant probably taking some kind of action against you, too, especially if you gave them the impression that you were in a position to rent it out.
….also, in Illinois, you can be charged with fraud…
(1 to 10 years + $10,000 fine, for each offence)
If your lease states that subletting is not allowed, everyone is correct that you and the sub tenants can all be evicted. In most cases (I only really know California) it will result in a public record on your credit report andyou will not only be responsible until it is re rented, you will be responsible for all the attorneys fees and costs incurred in the eviction.
please let us know how it turns out by posting on here
es i agree it depends if your complex allows subletting. some do while others don’t if they do then nothing happens. if they don’t they can evict you without taking you to court and you may have to pay fines. read your lease
