When does it become harassment?

Asked by WestRiverrat (20132points) May 21st, 2010

I get off work about the same time the bars close. I don’t drink. I have been pulled over 4 times in the last two weeks by the same patrolman. I have gotten off with warning tickets or verbal warnings each time. Had to do sobriety tests the first time.

I was pulled over once for weaving in my lane when I swerved to avoid some debris. Once for going 47 in a 45, once for failure to dim my already dimmed lights. The last time was a rolling sobriety checkpoint.

When does it stop being doing his job and start being a power trip?

I would think after going 47 in a 45. But I would also have to ask, is this the same patrolman? And would it be beneath you to take a different route home? I hope you are documenting all incidences and don’t hesitate to notify his superior.

Whats the area like? Are there lots of drunks driving around? Do the cops stop everyone?

The cop is making a quick rule of thumb decision on who to stop. If he expects a lot of drunks on that road, maybe he is just being extra careful.

It could be a power trip. Its hard to say without being there and seeing how the cop acts when he stops you.

When he pulled you over for failure to dim your already dimmed lights. Get yourself a dash cam and video Barney Fife acting the ass. File a formal complaint too.
