Placing someone under citizen's arrest for trespassing in Florida?

We moved into a new house in a small gated community in South Orlando in april 2010 and everything was going fine until maybe 2–3 days later I noticed some people jumping the fence and some even braking/popping the corner of the fence in order to cross our yard and go to their friend’s house. Our biggest problem is that most of them are minors 8yrs-16yrs but we have seen some people that look to be well into their 20s. We do have a security camera installed out back because the neighbors told us that this particular house has been broken into by people jumping from the other two communities that share the fence with us and the fence has “Private Property” signs on all 3 sides BUT what good is a camera if I don’t know the names of the people jumping, where they live and by the time they see us they either jump back or start running as we tell them to stop jumping & braking the fence. I have called the non emergency number but by the time they get here the kids are gone. What can I due? I was planning on planting some rose bushes along the fence but some one told me that if they get injured WE are responsible for it even if they are on our property.

so what about if you have a gun and shoot them, you are on your property and the are trespassing, rose bushes injuries are worse??? BTW Don’t shoot them! It was just an example

Barbed wire.

lol, yeah if my roof covered the entire backyard I supposed I could do that…Heck if that was the case I would even let them choose what caliber they want me to use…Yeah we thought Barbed wire as well but that looks too ugly and will get my wite fence dirty but our HOA already told our neighbor her couldn’t due that

In my neigborhood, when a kid walks across your yard, it’s considered “a kid walking across your yard.”

well not in ours, unfortunately the kids from the other communities have nothing better to due than to ride their bikes over our flowers b/c not only due they jump but they throguh their bikes over the fence and ride it to the street meaning going over my flower bed, they also have been seen checking unlocked cars, and we have already had to replace the broken fence areas.

@Michelle89: I’d like to answer this but your spelling is giving me a migraine.

Join with all the other residents of your gated community and hire a security guard if you find the kids’ behavior untenable – all that braking and throguhing must be really annoying. Due not worry about revenge.

Yeah we tried that as well but people here are not very neighborly, most of the community is surrounded by a concervation area, only about 8–10 houses are being affected. Imagine like an L shapes street, the short side and 2 houses from the long side have a community on the other side of the fence, the rest of the long side has the 417 behind it. We are dead smack in the corner where the short & long side meet, and the long side is a different community from the short side. Anyways, only the houses that are close by are being targeted and once they have done what ever it is they jumped over to due, they run back over the fence, we have even seen them running along side of the 417. My biggest fear is that someone tries to break in or due something while I am here with my newborn.

You live in a gated community that doesn’t have a security guard? What the hell are you paying HOA fees for?

I recommend contacting a lawyer to learn what your specific rights are in this situation.
