Do you think the government has the right to arrest a women for having loud sex?

Asked by Pandora (32398points) June 29th, 2010

A woman in Britian is facing a judge again for having loud sex. Her neighbors complain that its so loud they can hear her and her spouse doing it for up to 3 hours, midnight till 3 am. The neighbor even recorded it. It have the volume of a lawn mower cutting grass.
She was found guilty before and had a 8 week sentence suspended but this is her third offense and will probably have to do jail time.
Should she get prision? Or do you think this is too personal and the government shouldn’t get involved? By the way. According to neighbors its every night. Article

Was she arrested for a “Peaceful Enjoyment” infraction, or for having sex? She can do some sound-proofing and mow the lawn all night every night if she wants to.

Pandora's avatar

It was more about the noise.
Agree if she needs to yell that much than she should sound proof her place.

Pandora's avatar

I meant to say it had half the volume not have

I don’t know how noise violation laws in Great Britain work but if she did that here, after a certain hour and it really sounded “like murder,” I’d be tempted to call in on her too. Disturbing personal quiet time (or whatever they call it) is a legitimate frustration to get in trouble for.

I agree she should be soundproofing heavily, have sex in the basement, or move to a more solitary area

Imagine that she effectively soundproof her walls, ceiling and even her floor so her neighbour can’t hear her sexual antics. Can you picture them with their ears to her walls and door, hoping to hear it again.

Pandora's avatar

@Dr_Lawrence Unless they are an extremely sexy looking couple, I really don’t want to imagine it.
I did have a young couple who was a bit loud when making love, but at least they didn’t go at it like bunnies all night long. It was usually quick. I admit, I did like to hear it a little because I use to laugh when I would hear it end. You would always hear him, go UUUUUgggggggggHHHHHH and then silence. It still cracks me up today. LOL

Why didn’t they arrest her partner? It takes two to tango, as they say.

JLeslie's avatar

According to the article she was warned many times. She is ignoring the law, and sees nothing wrong with her behavior, so in her case I guess extreme action had to be taken to get the message across.

Pandora's avatar

@Mamradpivo Apparently he doesn’t wail like she does. 3 hours, he’s probably dehydrated. LOL

keobooks's avatar

if she doesn’t see anything wrong with it, perhaps someone should record it and then play it full blast for her at 3 AM while she’s sound asleep—several times.

partyparty's avatar

Well it really doesn’t matter what the noise disturbance is. If she is keeping her neighbours awake at night, then I think it is justifiable that she is arrested, fined and perhaps imprisoned.

We all like to be given the opportunity to sleep at night, not to have to listen to someone else causing a nuisance.

The loud sex may be pleasurable for her and her SO, but not so for her neighbours!

I agree with @keobooks… how would she like it if she was kept awake at night?!?!?

roundsquare's avatar

There’s nothing personal about a sound violation. As long as they treated it the same as playing music too loud, I think its fine.

Adirondackwannabe's avatar

Disturbing the neighbors is disturbing the neighbors. That’s black and white. What I want are some tips from the guy.

SuperMouse's avatar

I once had neighbors who did it incredibly loudly, every hour on the hour all night long. Having had that experience, I would have to say that if this woman was warned several times and her noise rose to the level of a lawn mower, she deserves what she got.

Britain has been cracking down increasingly lately on obnoxious behavior infractions. It is part of their current culture. When it was more of a homogenous society, there seemed to be more tolerance for vagaries or eccentricities or maybe there were less of them. I have some empathy for the neighbors, loud noises of any sort are annoying when you are trying to sleep.

Neizvestnaya's avatar

I don’t see a need for arrest but am in support of assessing a noise disturbance fine. Yay great sex but like barking dogs, arguing, leaf blowers and loud music then enough is enough after a time most people are deemed to be indoors for peaceful time.

mattbrowne's avatar

The cause of a noise violation doesn’t matter in Germany. There only one exception. Babies have the right to be loud and noisy. There was a leading decision about 2 years ago.

So the answer I guess is: yes. No sex above 110 decibel levels except in single-unit detached houses.

I looked up their picture .. they are an interesting looking couple.

Do they live in an apartment building? If so, she should be evicted. They should consider moving to a secluded aread where nobody will be able to hear them. But jail time? That’s harsh.

chyna's avatar

Not getting why you have to yell, scream during sex.

Adirondackwannabe's avatar

@chyna Maybe it encourages her guy?

chyna's avatar

Wouldn’t he be deaf by the time it was over? If she’s yelling so loud the neighbors can hear, what must it sound like to him?

Adirondackwannabe's avatar

I hadn’t thought of that. Imagine what he hears.lol.

zenele's avatar

@chyna What’s not to get? Some women just do. And we like it. Right guys?

Adirondackwannabe's avatar

I like noise as opposed to silence.

chyna's avatar

@Really? Because an ex-boyfriend was very vocal and to me, it was embarrassing. He lived in an apartment and I was sure he was bothering the neighbors.

@Adirondackwannabe But that much noise? Yes a little encouragement is great, but sounding like a lawnmower?

sleepdoc's avatar

Hopefully he doesn’t need that much encouragement ... that would be over the top

Adirondackwannabe's avatar

@chyna That would be a little much. Maybe if he isn’t satisfying her, she gets louder? So she’s getting busted for lousy sex.

chyna's avatar

They need to find a house with no close neighbors so they can go at it as loud as they want to. I don’t think she deserves prison time, but a fine wouldn’t be out of order for noise pollution.

Adirondackwannabe's avatar

A little consideration for the neighbors and the kids in the neighborhood would be nice.

zenele's avatar

In this specific case I’m going to go with she’s probably hard of hearing, as are most people who are too loud.

Adirondackwannabe's avatar

Good point zenele.

chyna's avatar

@zenele Don’t you think he is too by now?

Pandora's avatar

@chyna LMAO, Poor guy is probably, “What!” and then she screams louder. Maybe its not even sex noise. She’s giving loud instructions, NOW PUT IT HERE! Thats why it takes 3 hours.

chyna's avatar

@Pandora I love this question!

Pandora's avatar

@chyna Thanks, I thought it may be fun. :)
I laughed when I first came upon the article. Thought flutherites would find it amusing.

zenele's avatar

It’s still better than no sex at all, right?

Loud sex, quiet sex.

Sex is like pizza; it’s always good.

janbb's avatar

Even with anchovies on it?

zenele's avatar

If that’s how you like it.

chyna's avatar

@zenel It’s still better than no sex at all, right?
I don’t know, I can’t remember.

zenele's avatar

Can’t help you there.

2prudes's avatar

It sounds like they need to use other measures to keep the noise down. Ball gags might work, as well as a muzzle, that might work if it is on tight enough. but then hey, how many people can say they went to jail because they were having awesome sex?

Adirondackwannabe's avatar

@2prudes Great answer. Welcome to fluther. I like the ball gag idea.

2prudes's avatar

@Adirondackwannabe
I enjoy it when I can get it;)

Adirondackwannabe's avatar

@2prudes Another thought: They should be arrested if they never give their partner enough pleasure to be arrested for the noise.
