My husband had his drivers license suspended for 2 weeks for a work zone violation?

and now the letter that came back with the license says he now has 5 points instead of the 3 they told us !! We are in Pa

It does beleive me !! I mean if you hit someone working doing 55 or hit someone doing 78 aren’t they dead anyway ??

And we went and fought this ticket .. They took one point off for us then gave us 5 ???? Does it make any sense at all ??

she took one of the 4 points given off , then we got 5 instead when the license came back from the state

Well, I think the “needlessly” is up for debate… what with hitting “someone doing 78” and all.

That aside, how about getting a lawyer?

Or maybe see if you can get a transcript of the judge’s order from the court clerk?

We never hit anyone… I was kidding about that !! We were doing 78 in a 55 work zone… there was noone working

I think it was a trap .. it was a big weekend for picking up college kids

I’d call a lawyer. You don’t have a question, you have a rant and a complaint, and there’s not much Flutherites, scattered all over the world, can do.

That said, doing 78 in a 55 zone is most likely driving to endanger—it’s more than 20 miles per hour over the speed limit—and unless the work zone and speed limit were not clearly marked, I don’t think you have a leg to stand on. Whether there are people working or not is irrelevant. Consider using cruise control next time.

He had no points on his license , and the 65 mile per hour signs were NOT covered up , and everyone was going that speed…... we go from Philly to Pittsburgh in one day everytime we pick our son up from school…. it is scary out there

Now that you have actually asked a question, did you consider that people on fluther are probably not the ones to ask? maybe you should talk to the judge who presided over the case or someone in Pa. who can do something about it, if you are that upset.
By the way, it is not really a trap if the posted speed limit is exceeded. You see, if you drive the speed limit, even if it is a trap, they have no cause to give you a ticket, especially if you don’t hit someone, at either speed.

so the original speed limit was 65, lowered to 55 for a work zone, and you were going 78? You were speeding either way, stop complaining and grin and bear it, in two years they should be off his record.

There’s nothing else you can do. There’s a reason the double fines in work zones, whether people are working or not, keep that in mind next time.

Everyone speeds , one time or another…. ever drive on 95 ??? You have to do 70 or die from getting run over… just a fact !!

I’m aware of this fact, and I myself speed, but I never go more than 8 miles over the limit, and never speed in work zones, it doesn’t matter what everyone else does, you’re just the one that happened to get caught. you were going 13 miles an hour over the original limit, 23 over the work zone limit, some states have different thresholds for ticketing, here in MD it tends to be around 11 over the limit. There’s little you can do to change what happened. Go to your local MVA or DMV or what ever you call the agency that deals with drivers liscences and such and ask if getting a transcript if your hearing would help.

Your husband has the points either way, like I said, in 2 years they will have never existed, be more careful next time.

I know the work zone was wierd because the 65 MPH signs were not covered and I ( who was in the passenger seat ) never saw the 55 ones… it was his fault but what I thought was wierd was we fought it and had 1 point taken off , then when his license came back from the state it said he now had 5 points… He is going to call the judges today and talk to her… who know thanks :-)

The reason I asked about pre-existing violations is that most times in traffic court, they’ll be very lenient on first offenses. Even without a lawyer, you can plea bargain down to a minor offense with negligible punishment.

Unfortunately, it seems you’ve already had your day in court. The judge has all the latitude in the world to punish the offense within the limits of the statute (in some states, exceeding the speed limit by 15 mph is sufficient cause to suspend a license altogether).

So I hope you’re able to get a transcript or otherwise convince the judge that a clerical error was made. For a first offense, and I would make mention of that at every possible opportunity, they should be willing to listen.

Again, getting a lawyer would likely help the most at this point, if your husband is unable to talk to the judge directly today.

BTW, at this point in time, it’s no good complaining about:
– what you perceive the posted speed limit was at that time
– how likely human beings are to die when struck at 55 or 78mph
– what the typical speed of other traffic is on the turnpike

Before your court date, your only recourse was to get photographic evidence of what the actual posted speed limits were where you were caught. You could also request certification records for the policeman’s radar training, his radar equipment, the equipment that certified his radar, etc. And then with a good lawyer, probably could have walked out of court completely free.

But now it’s too late. Your immediate hope now is to convince the judge a clerical error was made in the execution of her judgement.

Try to focus on that.

Traffic tickets suck… but in my limited experience, I’ve seen what appears to be an institution-wide effort to minimize punishment on first-time (or infrequent) offenders. Much of that leniency is accessible to us non-lawyer folks.

(Now the folks whose lives have been ruined by repeat-offender DUI might chime in here to say it’s too lenient in too many cases.)

Unfortunately, it doesn’t sound like it really came into play for you here. But then, we’ve only got a very small portion of the story, I’m sure.
